A recent court case, Kwong v. United States, has opened the door for some taxpayers to potentially receive refunds or abatements of certain IRS penalties and interest assessed during the COVID-19 disaster period.
The ruling centers around IRS deadline extensions and relief provisions that were in effect during the pandemic years (generally covering portions of 2020–2023).
What this could mean for you:
• Possible refund of IRS penalties
• Possible reduction or removal of related interest
• Potential eligibility for individuals and businesses who received IRS penalty notices during the COVID period
While the IRS is currently appealing the decision and refunds are not guaranteed, taxpayers may still be able to file a protective claim to preserve their rights before the filing deadline (July 10, 2026) expires.
